Unfenced hazard

The facts

A construction project involved an addition to the science faculty of a large Canadian university. A subcontractor poured concrete for the sidewalk extension around the new building. However, they failed to install fencing to keep pedestrians outside of the construction area, and there was an elevation difference between the form work and the sidewalk. 

A few days later, before the elevation difference had been corrected, a professor tripped over the form work and fell to the ground, sustaining severe soft tissue injuries to her ankle and wrist.

The result

Fortunately, the general contractor had purchased a project-specific Wrap-Up Liability insurance policy with Victor. The policy insured the project owner, the general contractor and all subcontractors. All of these policyholders were named in the action and protected as a result of the Wrap-Up Liability coverage. The claim was settled a few years later.

The professor (the injured party) who had sustained injuries was a contract employee at the university and was unable to work for an extended period of time. The injured party made a claim for $250,000 along with extensive physiotherapy treatment.  

Risk factor

Implementing and maintaining robust construction site security measures is vital in preventing injury to third parties. Litigation on bodily injury claims can be protracted and take longer to resolve.
